These Terms & Conditions (“Terms”) govern your access to and use of the Dev Se Mahadev mobile application (the “App”, “DSM”, “we”, “our”, or “us”), operated by Dev Se Mahadev Welfare Society. Please read these Terms carefully before using the App. By creating an account or using the App, you agree to be bound by these Terms.

1.Acceptance of Terms

By downloading, registering on, accessing, or using the DSM App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, you must not use the App.

We may require you to expressly accept these Terms (for example, via a checkbox at sign-up) before you can use certain features. Your acceptance at sign-up, together with continued use of the App, constitutes your agreement to the version of the Terms in effect at that time.

2.Definitions

• “Account” means the registered user account created to access the App.
• “Jaap Session” means a devotional chanting/prayer session hosted or facilitated through the App, including live sessions.
• “Presence Verification” means the on-device liveness/face check used to confirm a genuine live human is present during a session.
• “Reward” or “Jaap Reward” means any voluntary, discretionary engagement reward described in Section 7.
• “Points” means the engagement units accrued for qualifying participation, as described in Section 7.

3.Eligibility

You must be at least 18 years of age to create an Account and use the App. If you are below 18, you may use the App only under the supervision and with the verifiable consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the App, you represent that you meet these requirements and that all information you provide is true and accurate.

4.Account Registration & Security

• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account.
• One person may hold only one Account. Creating multiple or fake Accounts—particularly to gain additional Rewards—is prohibited.
• You must notify us promptly of any unauthorized use of your Account.
• We may refuse, suspend, or terminate Accounts at our discretion, including for violation of these Terms.

5.Nature of the Service

DSM is a devotional application that enables users to participate in spiritual and chanting activities, including live Jaap Sessions, and to track their participation. The App and its content are provided for personal, devotional, and non-commercial use. Participation is a matter of personal faith and choice; we make no religious, spiritual, or outcome-based guarantees of any kind.

6.Presence & Liveness Verification

To confirm genuine participation in Jaap Sessions, the App uses camera-based Presence Verification (liveness detection).

• Liveness checks are performed to confirm that a real, live person is present during a session and to prevent spoofing (e.g., photos, videos, or automated fakes).
• Presence Verification runs on your device; it is used solely for participation verification and reward eligibility, and not to build any facial-identity database.
• By using session features, you consent to the App accessing your device camera for this purpose. You may withdraw consent by discontinuing use of session features, though this may make you ineligible for related Rewards.

7.Jaap Rewards & Points

• How Points accrue: Users may earn Points for qualifying participation in Jaap Sessions (for example, completing a qualifying session on a given day). The qualifying criteria, session thresholds, and daily limits are set by us and may be changed from time to time.
• Conversion: Points may be converted to a Reward amount at a rate determined by us (currently indicative only and configurable). The conversion rate, eligibility threshold, and payout frequency may be modified, paused, or discontinued at any time without prior notice.
• Payout details: To receive a Reward, you may voluntarily add your bank account details within the App. You are solely responsible for the accuracy of these details. We are not liable for Rewards sent to an incorrect account arising from details you provided.
• Processing: Reward disbursement is processed periodically (e.g., via automated batch) to eligible users and may be routed through third-party payment providers, subject to their terms and to applicable verification.
• Taxes: Any taxes, levies, or reporting obligations arising from a Reward are your sole responsibility.
• Integrity: We may withhold, reverse, adjust, or cancel Points or Rewards where we reasonably suspect fraud, spoofing of Presence Verification, automation, multiple accounts, or any violation of these Terms.
• Points and Rewards have no cash value except as expressly provided here, are non-transferable, and confer no ownership or vested right.

8.Payments & Third-Party Providers

Reward disbursements and any in-App payments may be facilitated by third-party payment gateways and banking partners. Your use of such services is subject to their respective terms and privacy policies. We are not responsible for delays, failures, or errors caused by third-party providers, banks, or payment networks.

9.Acceptable Use

You agree that you will not:

• Attempt to bypass, spoof, or defeat Presence/Liveness Verification by any means.
• Use bots, scripts, emulators, or any automation to interact with the App or to farm Points or Rewards.
• Create multiple or fraudulent Accounts, or impersonate any person or entity.
• Upload or share content that is unlawful, obscene, hateful, infringing, or that disrespects religious sentiments.
• Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the App or its systems.
• Use the App for any purpose that is unlawful or prohibited by these Terms.

10.User Content

You retain ownership of content you submit through the App. By submitting content, you grant us a non-exclusive, royalty-free license to host, store, and use that content solely to operate and provide the App. You are responsible for the content you submit and confirm you have the rights to share it.

11.Intellectual Property

The App, including its name, logo, design, text, graphics, software, and other materials (excluding user content), is owned by or licensed to Dev Se Mahadev Welfare Society and is protected by applicable intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

12.Third-Party Services & Links

The App may use or link to third-party services (such as authentication, streaming, cloud, analytics, or payment providers). We do not control and are not responsible for the content, policies, or practices of any third party.

13.Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to those practices.

14.Disclaimers

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components. Devotional content is provided for personal faith and reflection, and we make no guarantee of any spiritual, religious, or material outcome.

15.Limitation of Liability

To the maximum extent permitted by law, Dev Se Mahadev Welfare Society and its officers, members, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the App. Our total aggregate liability for any claim shall not exceed the amount, if any, paid by you to us in connection with the App.

16.Indemnification

You agree to indemnify and hold harmless Dev Se Mahadev Welfare Society and its representatives from any claims, damages, losses, liabilities, and expenses arising out of your use of the App, your content, or your violation of these Terms or of any applicable law.

17.Suspension & Termination

We may suspend or terminate your access to the App, in whole or in part, at any time and without prior notice, if we reasonably believe you have violated these Terms or engaged in fraudulent or harmful conduct. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Sections 7, 11, 14, 15, 16, and 19) will survive.

18.Changes to the Service and Terms

We may modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time; changes take effect when the updated Terms are posted, as reflected by the “Last Updated” date. Your continued use of the App after changes indicates your acceptance of the updated Terms.

19.Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. The courts at Indore, Madhya Pradesh shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the App.
